Abstract
The Second Additional Protocol to the Budapest Convention on Cybercrime is being prepared during the last 3 years, trying to capture some of the most complicated aspects of cybercrime-such as mutual legal assistance, cooperation between authorities and service providers (in general) and data protection requirements. Because of the limitations on fundamental rights and freedoms that the previous issues bring, it would be extremely interesting how individuals and legal entities would be protected in terms of the EU Charter of Fundamental Rights, general principles of the EU law, and the European Court of Justice's case law.
